WORLD INTERNET CENTRAL COMPLAINTS HANDLING POLICY

  1. Background

    The World Internet Central Terms of Service prohibit registered users from using the Website or the Services:

    • in a manner or for any purpose that is unlawful or violates the legal rights (including copyright) of any person
    • to stalk, harass, intimidate, defame or vilify any person
    • to upload, transmit, publish, distribute or store offensive, obscene, racist or pornographic material, or
    • send unsolicited electronic messages to any person in breach of Australian laws or in breach of the law of any country to which an electronic message is sent
    • (‘prohibited conduct’)

    Our terms entitle us to delete user submitted content and terminate or suspend a registered user’s access to the Website or Services, including for breach of our terms.

    This is our policy on complaints regarding prohibited conduct. We reserve the right to vary this policy from time to time and to depart from it in particular cases if we consider it appropriate to do so.

  2. Our rights

    Nothing in this policy restricts our right to delete content, terminate or suspend a registered user’s access. We may do so even if no complaint has been made.

  3. Complaints

    Complaints must be in writing (email is acceptable) and either:

    1. In the prescribed form, or
    2. Contain all of the information required by the prescribed form.

    We will investigate complaints in a timely manner.

  4. Outcome of complaints

    If we determine that a user has not engaged in prohibited conduct we will inform the complainant of this and they can seek recourse directly against the user.

    If we determine that a user has or may have engaged in prohibited conduct, we will provide them with a copy of the complaint and give them a reasonable opportunity to respond to the complaint.

    If we determine the response satisfactory, we will inform the complainant and they can seek recourse directly against the user. If we determine the response unsatisfactory, we may:

    • delete the content the subject of the complaint (where relevant)
    • issue a warning to the user, and / or
    • terminate or suspend a user’s registration, at our sole discretion.
  5. Copyright infringement complaints

    Complaints of copyright infringement will be handled in accordance with this policy, provided that if a complaint is verified by:

    • statutory declaration or affidavit of the copyright owner (or its authorised officer), or
    • the copyright owner’s legal representatives –
    • we will immediately suspend the content the subject of the complaint pending the outcome of the complaint.
